Terms & Conditions
Hopefully most of this goes without saying, but by making a booking you agree to be bound by the following terms and conditions. Please don't be put off by the length; my husband's a lawyer and he made me put them in!
Check In/ Check Out
1. You are welcome to "Check in" anytime after 4pm on your day of arrival (or earlier if prior arrangements have been made with us) . "Check out" is anytime before 10am on your last day. Please let us know your estimated time of arrival.
2. You undertake to leave the cottage without demand at the termination of the agreed period of hire.
Payment
3. We require an initial deposit of £100 to secure your booking. This deposit is non-refundable. Please provide the deposit at the time of booking. Cheques should be made payable to "Dr Alison Murray".
4. Your holiday should be paid in full, at least eight weeks before commencement (unless, of course, there is less than eight weeks to go!). Payments can be made by cheque, (provided enough time is allowed for the cheque to clear before your holiday starts) or electronic transfer. We can provide bank account details for an electronic transfer on request. Bookings made less than eight weeks before commencement should be paid for in full at the time of booking.
5. Please make sure we receive your payment on time, as we may re-book as soon as the due date for payment has past.
6. A further deposit of £100 must be provided with your final payment. This deposit is to ensure that you look after the holiday home as though it were your own. The cost of any damaged or missing items or exceptional cleaning will be deducted from this deposit and the remainder returned to you. We reserve the right to invoice the person booking the holiday for any amounts above the paid deposit. So far we have never had to do this!
7. We will do everything we reasonably can to honour our commitments to you, but in the extremely unlikely event of the property not being available for any reason or any other problem arises you accept our maximum liability to you on any grounds whatsoever is limited to the amount you have paid us prior to the problem arising.
Looking after Cornellan Cottage
8. There is strictly No Smoking within the cottage. (A surcharge will be made for cleaning fabrics on evidence of smoking in the cottage.)
9. To keep the property looking great we restrict the number of guests to a maximum of 4 at any one time (plus one baby - a cot, high-chair etc. is available on request).
10. No pets are permitted- sorry.
11. In the unlikely event you discover any damaged items on arrival, you agree to let us know immedately (so we can arrange a repair/replacement as soon as possible).
12. During your stay, you are responsible for the contents of the property, and we will pass on the cost of any damage/breakages to you (beyond reasonable wear and tear).
13. You agree to leave the cottage in a clean and tidy condition.
Security
14. Ballater is a quiet place, so it is very unlikely you will have any problems. However you agree to apply common sense and lock up when you go out. In the unlikely event anything of yours is stolen from the cottage (locked or unlocked) it will be your own responsibility.
What's Included
15. Use of linen and towels will be provided at no extra charge.
16. Electricity is included.
Nature of Contract/Occupancy Right
17. A contract between us shall only come into existence when we accept your booking.
18. You warrant that the cottage will be used only for the purposes of a holiday.
19. You shall not sub-let the cottage or any part thereof.
20. You agree that the cottage shall be used soley for the purposes of a holiday let to which section 12(2) and paragraph 8 of Schedule 4 of the Housing (Scotland) Act 1988 applies. The booking agreement confers a right to occupy the cottage for the agreed period only.
Cancellations
21. You agree that, in the event of cancellation, while we will make reasonable efforts to re-let, if a substitute cannot be found you will remain responsible for paying for the period you booked. (You should be able to get insurance for this if you wish.)
22. We may treat the booking as cancelled if the balance of the payment is not sent by the date agreed.
Tranquility
23. Ballater is a tranquil place, and we ask your help us in keeping it that way. You agree to prevent any member of your party from causing a nuisance or disturbance in or around the cottage. In the event of such a problem arising, we reserve the right to require you to vacate the property on demand without payment of compensation to you.
Acts of God
24. Your booking is accepted on the understanding that the cottage will be put at your disposal on the date agreed with us. Should this not be possible due to circumstances beyond our reasonable control, we cannot guarantee to provide an alternative holiday property. In this case the rental you have paid will be returned to you in full and you will have no further claim against us.
Dispute Resolution
25. We would aim to resolve any disputes quickly and amicably - as we want lots of regular guests! However if we can't resolve any disputes by agreement you and we agree to Scots law applying and prorogate the exclusive jurisdiction of Aberdeen Sheriff Court.
